Please read the following terms and conditions carefully (the “Terms”) for the use of the www.twosides.org.au website (the “Site”). The Two Sides ANZ privacy policy set out on the Site forms an integral part of these Terms and should be read in conjunction with them.  Any condition or restriction set out in the Privacy Policy is deemed to be part of the Terms.

The Site is owned and operated by Two Sides ANZ, for the purpose of gathering and promoting information about the sustainability of the paper, pulp and printing industries.

Two Sides ANZ reserves the right to change or vary the Terms at any time by posting changes online. Please review the Terms regularly to ensure you are aware of any such changes. Your continued use of the Site after changes or variations are posted means you agree to be legally bound by the Terms as updated and/or amended.

Use of the Site

All material included in the Site is intended for information purposes only. You should not act nor refrain from acting on the basis of information contained in the Site without first verifying the information and obtaining legal and/or professional advice as necessary.

Whilst Two Sides ANZ endeavours to ensure that the information on the Site is correct, Two Sides ANZ makes no (and expressly disclaims all) representations, warranties, conditions and other terms including those expressed or implied by statute, collaterally, or otherwise, with respect to this Site and its contents.

Except as specifically stated on the Site, neither Two Sides ANZ, nor any of its affiliates, directors or employees or other representatives will be liable for damages arising out of or in connection with the use of this Site. This is a comprehensive limitation of liability that applies to any and all losses, damages or costs of any kind, including (without limitation) direct, indirect and consequential losses, loss of data, income and profit, loss of goodwill, wasted expenditure, loss of and damage to property and claims of third parties.

When subscribing to the Two Sides ANZ website you must not impersonate another person. As a subscriber, we may at any time request a form of identification to verify your identity.

You must take all necessary steps to secure and ensure the confidentiality of your membership details. You are wholly responsible for all activities which occur under your membership and or subscription details. You must notify us immediately if you become aware of any unauthorised use of your membership and or subscription details.

Your conduct

In using the Two Sides ANZ website or any related service, you agree:

• not to attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the website.
• not to tamper with other persons’ access to the website or commit unauthorised intrusion into any part of the website, including computers, files, accounts, networks and equipment.
• not to attempt to bypass any firewall or security relating to the website.
• not to use any part of the website for which you are not authorised or devise ways to circumvent security in order to access part of the website for which you are not authorised – including but not limited to, scanning networks with the intent to breach and/or evaluate security, whether or not the intrusion results in access or not.
• not to attempt to misuse the website – including but not limited to password cracking, social engineering (defrauding others into releasing their passwords), denial-of-service attacks, harmful and malicious destruction of data, injection of computer viruses, or intentional invasion of privacy.

You agree that material downloaded or otherwise accessed through the use of the Site is obtained entirely at your own risk and that you will be entirely responsible for any resulting damage to software or computer systems and/or any resulting loss of data, even if such loss and damage were reasonably foreseeable.

Two Sides ANZ does not accept responsibility for, or liability incurred through, the operation or content of any third-party web sites that can be accessed through the Site nor does it by reason of a link to such websites appearing on the Site endorse or approve the contents of those websites.

Intellectual Property

Save as set out in under Third Party Content below, the content of the Site including text, software, scripts, graphics, photos, sounds, music, videos and interactive features, and the trademarks, service marks and logos are owned by or licensed to Two Sides ANZ and the content is subject to copyright and other intellectual property rights which belong exclusively to Two Sides ANZ.

The content of the Website may not be reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any other purposes whatsoever without the prior written consent of Two Sides ANZ.  By accessing the Site you agree not to distribute any of the content of the Site other than as expressly permitted under these Terms.

You may download material from this Site for personal and internal use only. You may print copies of any item in hard copy, or download to a local hard disk extract from the Site, for your personal use or for use by others within your organisation, provided that you do not amend, alter, edit or delete any part of it or combine it with another work.  You may recopy it to a third party for their personal use only provided that the source of the material as Two Sides ANZ is acknowledged and the third party is informed that the material may not be reproduced or copied.  It may not be supplied to any third party for commercial gain.

All comments, feedback, information or materials submitted to or through the Site shall be considered non-confidential and shall belong to Two Sides ANZ.  By submitting any materials to the Site, you hereby assign to Two Sides ANZ rights, title and interest in the copyright or other intellectual property rights to such material.

Third Party Content

The names, images and logos identifying any third parties and their products and services on the Site are subject to such copyright, patents, design rights and trademarks of the third parties that exist.  Nothing contained in the Terms shall be construed as conferring any licence or right to use any trademark, patent, design right or copyright of any third party.

Two Sides ANZ does not permit any material which infringes copyright or any other intellectual property rights to be uploaded onto the Site.  If Two Sides ANZ is notified by any person that any material on the Site infringes any other person’s rights, Two Sides ANZ will remove all that infringing material and/or submissions forthwith, without notice to the user.

Warranty Disclaimer

To the fullest extent permitted by law, Two Sides ANZ, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the Site and your use thereof.  Two Sides ANZ, its officers, directors, employees, and agents make no warranties or representations about the accuracy or completeness of the Site’s content and assume no liability or responsibility for:

• any errors, mistakes, or inaccuracies of content;
• personal injury or property damage of any nature whatsoever, resulting from your access to and use of the Site, any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein;
• any interruption or cessation of transmission to or from the Site;
• any bugs, viruses, or the like which may be transmitted to or through the Site by any third party; and/or
• any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Site.

You agree that your use of the Site shall be at your risk.  You further agree:

• not to circumvent, disable or otherwise interfere with security related features of the Site or features that prevent or restrict the use or copying of any content or enforce limitations on use of the Site or the content thereof.
• that, in submitting material to the Site, you will not include any material which may damage Two Sides ANZ or any third party or that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate.

Two Sides ANZ disclaims all and any liability in connection with submissions uploaded onto the Site.  It does not in any way endorse any submission or any opinion, recommendation or advice expressed therein, except insofar as any opinion, recommendation or advice is clearly expressed to be by representatives of Two Sides ANZ.

Limitation of Liability

Nothing in these terms shall exclude or in any way limit any liability to the extent such liability may not be excluded or limited as a matter of law.

Two Sides ANZ will not be liable for any loss of actual or anticipated income or profits, loss of contracts or for any special, indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise, whether or not such loss or damage is foreseeable, foreseen or known.

Two Sides ANZ reserves the right at any time to remove any material or submissions without prior notice which it deems to be unlawful, indecent, dishonest or in anyway detrimental to Two Sides ANZ.

Two Sides ANZ reserves the right to discontinue any aspect of the Website at any time.

Governing Law

These Terms shall be governed by Australian law. Any dispute or claim arising out of this policy and the use of your personal information will be governed by Australian law and the courts of Victoria will have exclusive jurisdiction over any dispute arising from the use of the site.  If any of these Terms is found to be invalid by a court with competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Conditions, which shall remain in full force and effect.
